Protection of Children's Personal Information (POPIA) Policy
Statutory privacy policy governing the processing, protection, and parental consent requirements for minor learners under Part C of the Protection of Personal Information Act (POPIA Sections 34 & 35, Act 4 of 2013).
1. Categories of Learner & Guardian Data
EduManage processes learner and guardian information strictly necessary for academic administration:
- Learner Profiles: Full name, national identity number or birth certificate number, date of birth, gender, home language, school photograph, and chronic medical condition/allergy alerts.
- Academic Evaluations: Subject marks, continuous assessments (CASS), term examination results, promotion status, and behavioral discipline infractions.
- Parent/Guardian Information: Full names, physical home address, mobile contact numbers, email addresses, and fee payment billing records.
- Attendance Telemetry: Daily register clocking, absenteeism notes, and extracurricular activity participation.
2. Parental Consent & SASA Admissions Mandate
2.1. Competent Person Consent: In accordance with Section 35(1) of POPIA, the School must obtain verified consent from a parent or legal guardian during learner enrollment to authorize processing of academic, medical, and photographic data on digital systems.
2.2. Zero Commercial Exploitation: TVB Network strictly prohibits any commercial advertising, profiling, behavioral targeting, or reselling of learner information.
3. Parental Rights of Access & Correction (Sections 23 & 24)
Parents and legal guardians possess statutory rights to:
- Access their child's academic gradebook, attendance logs, and financial statement via the authenticated EduManage Parent Portal.
- Request rectification of erroneous contact numbers, residential addresses, or medical alert notes.
4. Five-Year Post-Graduation Retention Policy
In accordance with the Department of Basic Education (DBE) National Information Policy and South African archival requirements:
- Learner matric portfolios, academic histories, and transfer cards are preserved in encrypted archives for five (5) years post-graduation or transfer.
- Disciplinary suspension records are purged or anonymized upon learner matriculation unless required for ongoing legal proceedings.
